These terms and conditions apply to all customers/visitors, and form the basis of every agreement made between us and you (the client). Please read these Terms and Conditions carefully because they form a contract between The Digital Room and our clients.
We reserve the right to modify these terms and conditions at any time and supersede all previous terms and conditions published on this site.
We reserve the right to refuse to print any images if these terms and conditions are not agreed to online. For instructions on how to agree these terms and conditions please contact us.
By submitting an image to us either by uploading the image to our website, via email, via direct FTP, on disc, any other file transfer service or as a photograph or negative in the post, and then making payment either online through our website, or separately by cheque, cash or bank transfer, you are confirming that you agree these terms and conditions in full.
We reserve the right to refuse any future services to any client that breaches our terms and conditions or who are abusive or rude to our staff.

Making a Purchase
Making a purchase could not be easier. Just browse our shop, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.
We accept credit and debit card payment and personal cheque. If you are shopping from outside the United Kingdom, place your order and your credit card company will convert the transaction to your own currency.
Because our products are printed to your order requirements, we require cleared payment prior to printing.
You will receive a confirmation of order email; this is to indicate that we have received your order.
We reserve the right not to reproduce any images which are offensive or contain inappropriate content. As a security measure we reserve the right to record the IP address of the computer used to upload any image to our site. If any illegal or pornographic images are uploaded to our site, we will inform the relevant authorities and provide any details we hold.
In submitting the image to us, the client confirms that they own the rights to the image or have obtained written permission to use the image for reproduction purposes. All copyright and intellectual property rights are retained by the client on any image submitted to us.
By agreeing to these terms and conditions, you agree to indemnify us and our staff and company against any action, claim, damages, liability, costs and expenses arising out of any claim with regard to infringement of a third parties copyright, intellectual property rights, or trade mark, due to the reproduction or processing of any image by us on behalf of you the client.
We reserve the right to contact you via telephone or email should we have any questions about your image prior to printing. We also reserve the right to make a judgement as to whether the image supplied to us is of sufficient quality to print at the size requested by the client. If the image is too small you will be informed and you will be asked to supply an alternative larger scale version of the image, or we will arrange a refund if this is unavailable.
Sales and offers
Our sales and offers are valid for the Canvas, Acrylic, MDF Block Mounts and Acrylic DeskBlocks. The discounts available are those advertised on each product page.
The sale is valid for the advertised period. We may at our discretion extend the sale or honour the sale prices for clients that have contacted us prior to the end date.
Turnaround Times
Our standard turnaround times vary depending on the product and on how busy we are at the time of order. We endeavour to complete orders within the advertised timescale, however if there problems beyond our control, such as missing images or poor quality images, we reserve the right to extend the turnaround time.
Our Rush turnaround times are set depending on the product, if you order using our 48hr or 72 hour service, this means that your print will be completed by the end of the period and then shipped. It does not mean you will receive the print within that timescale.
Acrylic Fotoblocs
All Fotobloc orders are now manufactured to order, we aim to deliver within 21 working days of order, however during busy periods this can take up to 28 days. We will inform you of any delay and give you the option to cancel. Once your order is received we will contact you with regard to obtaining your images for the frames.
E-Vouchers
These can be bought from our online store and are valid for 1 year from date of purchase. They are transferable but because each E-Voucher has a customer specific code, please inform us by email that you wish to transfer them; otherwise we may refuse to accept them until confirmation from the original buyer has been received. We will never accept an E-Voucher from a third party unless by prior arrangement by you. This is for your security.
Each E-Voucher can be used as full or part payment against any of our products. We will not exchange them for cash or other goods. If the value of the goods purchased is less than the face value we will issue a custom E-Voucher to the remainder value.
Each E-Voucher can only be used once, and when used, will be recorded as used in our E-Voucher database.
The E-Voucher is printed onto a 7" x 5" piece of canvas and despatched in a board backed envelope 1 working day from order. Note, the E-Voucher canvas is not framed. If you prefer we can email you a JPG version for you to print instead.
Picture of the Month Competition
The competition runs from 12 noon on the 1st day of each month until 11.59am on the 1st day of the following month. All winning entries will be notified by email.
All customers that wish to be entered into our 'Picture of the Month' competition will be entered into the competition on the 1st day of the following Month.
By entering the competition customers agree that we may use the image entered for promotional purposes on our website for the duration of the following month as we so wish. We will not use the image anywhere else or allow anyone else to do so.
The Prize is a £50.00 E-voucher for use on our site. This may be used be used as full or part payment against any of our Products available on this website. We will not exchange them for cash or other goods. If the value of the goods purchased with the E-Voucher is less than the face value we will not issue refund.
Circumstances resulting from image theft from our website are not our responsibility and you agree to identify us and our agents from any claim that you may have. We will of course provide help in every way we can to stop image theft.
All image intellectual property rights and copyrights remain with the Customer.
A list of winner's names will be available on request.
Simply order your canvas print through our online shop and just add the words 'Yes Picture of the Month' in the answer box for 'Would you like to be entered into one of our photo competitions?' at our checkout.
Should you wish to enter the competition without making a purchase, you can email your image to us, stating that you wish to be entered into the competition for that month.
Other Competitions
From time to time we advertise competitions that we are running in conjunction with third parties, these competitions are governed by the relevant third party and subject to that third party's own terms and conditions.
No negotiation will be entered into, however we are happy to give the third party's contact details upon application.
Fixing Prints to Your Wall
Many of our larger prints are very heavy, care should be taken when lifting them and when selecting the place to hang them.
Ensure that you use suitable weight bearing fixings for the type of wall that you intend to hang the print onto. Seek advice from a professional builder should you be unsure of the type of wall fixing you need.
We will not accept responsibility for damage to the print or any third party property or persons, caused by insufficient fixings used to hang your print.
Product Descriptions
We attempt to describe the products offered on the website as accurately as possible. However, we do not warrant that product descriptions or other content of the website are accurate, complete, reliable, current or error-free. If a product offered by us and purchased by you is not as described, your sole remedy is to return it in unused condition for a refund or credit.
VAT
For orders made from the UK or the European Union, 17.5% VAT is included in the price
Should you require a VAT invoice for accounting purposes, please contact us on receipt of your order.
Shipping and Delivery
Our Products are printed to order; this means our standard shipping is approximately 7 - 10 working days from the date of cleared order payment.
Our 48hour service is based on shipping your canvas 48 working hours from cleared order payment. This service is only available for single canvas orders shipping to mainland UK destinations. Please contact us if you have any questions about this service. The table of delivery is shown on the website.
We use an overnight courier service to delivery our canvases. The courier will attempt delivery twice, and then they will hold the parcel at the local depot for 5 days prior to returning it to us. They will leave a card with contact details so that you may arrange to collect the parcel from their depot.Once returned redelivery from us will incur further charges.
It is the customer's responsibility to check for any damage that may have occurred during transit. You have 24 hours from the time of delivery to report any damage to us. It is essential that you contact us within the 24 hours, so that we can claim compensation from the courier company on your behalf, and reprint the canvas for you.
We endeavour to ship your item in the timescale stated above, however we do not guarantee this, If your canvas is damaged by us prior to shipping, we reserve the right to reprint. This may cause a delay in shipping. You will receive an email from us if this is the case.
From time to time we will run offers on shipping costs. These offers refer to shipping to The UK only.
International shipping is carried out our International Courier. Central Europe is ' Central Europe Standard delivery' We aim to deliver in Central Europe within 3 - 5 working days from shipping date. Rest of Europe is Europe Standard Delivery' we aim to deliver within 5 - 7 working days from ship date. Please note we do ship to the rest of the World, quotations available on request.
We will normally send your order to you within 7 - 10 working days of cleared order payment. International orders are generally received within 10 - 15 working days of cleared order payment.
All products purchased from us are made pursuant to a shipment contract. This means that the risk of loss and title for such products pass to you upon our delivery to the carrier.
International Shipping
Due to the extra risk of damage to items purchased from us when shipped internationally, we will not accept liability for any damage whatsoever caused by the shipping process. However we will ensure that the goods leave our premises or our suppliers premises in pristine condition and with extra packaging for protection.
When we supply a shipping quote for international parcels, it is just for shipping, it does not include any Customs Import Duties levied by the receprient's country's customs authority. These charges are payable by the customer.
We cannot be held responsible if you have not paid these in time and the parcel is returned to us. Extra shipping charges will apply should we have to reship the parcel.
We will however make every effort to communicate between us, our shipping agent, you and your countries custom authorities. It is extremely important to supply us with a valid contact telephone number and address to avoid any delays at customs.
Back Orders
If the frame size is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait. Like wise if you require a different frame size than those we hold in stock, these will be ordered for you, and may take up to 4 weeks to arrive.
Credit card security
Our Shopping cart is now protected by Geo Trust SSL Security.
When your order is placed at our website, all information given by you is encrypted using 128 bit encryption. The credit card transaction takes place at our payment service providers secure site. We do not have any access to your credit or debit card details. This is backed up by the Padlock shown in your browser during the checkout process.
We currently use Sagepay, HSBC E-Secure Payments and Paypal as our payment service provider. You do not need to have an account with Sagepay, HSBC E-Secure Payments or Paypal to use their services.
Shopping safety and accessibility

We are happy to operate a 14 day 'Cooling Off' period for your order, should you change your mind about your purchase we will give you a full refund. As the majority of our orders are despatched within 10 days of order, please email us should you wish to use the 'cooling off period'.
Where possible we have designed our website to be as accessible to all as possible, if you find a problem please email us.
Guarantee
All of our products come with care instructions and a 14 day no quibble guarantee. The guarantee covers defects in manufacturing, it does not cover colour reproduction. As canvas is a natural product, slight imperfections may exist in the canvas print; this is beyond our control and is not covered by our guarantee.

Privacy Policy
The Digital Room do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. Remittance Terms
All products are printed to order. Payment must be made in full prior to printing.
Returns Policy
Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.UK/si/si2000/20002334.htm
Goods may be returned to us if they are delivered in a defective state or they do not match the descriptions given on this website.
You are required to inform us immediately if it is your intention to reject the goods. You will receive email instructions about your return and subsequent refund.
Acrylic, MDF Blockmount, Canvas, Acrylic Deskblock or Paper prints ordered through our 'Your Image' section on our website, where the image to be printed has been, uploaded via our upload page, or emailed to us, or supplied on cdrom, to us by the client are deemed to be 'personalised items'. The return of these items will only be accepted if the canvas arrives damaged and we are informed immediately.
We do not charge a restocking fee for returned items.
Cancellation Policy
All products are printed to order, therefore if you wish to cancel your order, you need to advise us straight away. We will accept cancellation of the order up to the point where the production process has begun, in which case we will issue a refund, although we may charge an administration fee of £10.00. We may, at our discretion, accept a cancellation of the order after the production process has begun, but will we only offer a refund less any costs that have been incurred up to the point of cancellation.
Refund Policy
Any refund that we have agreed to make will be issued within 10 days of the refund agreement.
Colour Management
We have a strict policy not to adjust any colour settings or contrast / brightness settings, unless specifically asked to by the client
The Colour settings and the type of your computer monitor that you use to view your image, have an influence in the perception of how your image should look. You should be aware that unless your computer monitor's colour settings have been calibrated professionally, they may look different to the final print supplied by us. As we cannot guarantee the accuracy of your monitor, we will not accept colour reproduction including brightness or contrast as a valid reason for return.

Licence and website access
When you visit our website, we allow you a limited, revocable license to access and make personal use of our website as our customer.
However, you are not permitted to do any of the following:
- reproduce, duplicate, copy, sell or otherwise exploit the website or any product image, product listing, product description, price, page layout, page design, trademark, logo or other content ("website Content") for any commercial purpose without express written permission;
- use a robot, spider or data mining or extraction tool or process to monitor, extract or copy website Content (except in the operation or use of internet "search engines," hit counters or similar technology);

Trade Accounts
If you use the website with a trade login, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
If you are granted access to our image upload server using the File Transfer Protocol (FTP), it is your responsiblilty to keep all usernames and password secure. You are not permitted to allow other people to use your login unless they are in your employment. You are not permitted to upload anything other than images files that you wish to have printed. Failure to comply with these terms will result in termination of your account.
Photographer Credit Accounts
We operate credit accounts for our Photographer clients. These accounts are based on an agreed credit limit per month. If the credit limit is reached before the end of the month, the client is required to clear the outstanding balance prior to placing further orders.
We will invoice the client on the 1st day of the month for the previous months balance. The client hereby agrees to pay all outstanding balances within 7 days of the invoice date. We reserve the right to apply an interest charge of 8% per day on all outstanding balances until the paid.
Corporate Credit Accounts
Our corporate accounts are operated on a payment within 30 days of receipt of invoice basis. We reserve all title in the goods ordered until payment is received in full.
Late payment of invoices will result in the client's corporate credit account being limited. This will require all outstanding invoices becoming due for immediate payment and all future invoices being due for payment within 14 days of invoice date.
We reserve the right to hold shipment of further orders until payment of outstanding invoices has been received in full.
Modification And Severability
We reserve the right to make changes to our site, policies, and this Terms of Use agreement at any time and in our sole discretion; therefore, you should review our policies, terms, and conditions each time you visit the website. Your continued use of the website after we make any such changes constitutes your binding acceptance of those changes. If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.
